For anything more specific, some ATI user might be able to help ... Other than that, I can tell you that your CPU is a major bottleneck for anything newer then 7600GT or so .
I went to the sapphire site and DL'd the one right before (9.11) and they still wouldn't install properly. But I've read in a couple of searches Win 7 uses DirectX 11, and is backwards compatible with DX10. I paly COD4 much more so it rules for now. With Your 3000+ cpu overclocking will likely make no difference as You are cpu bottlenecked.
And that some newer ATI drivers/cards do have some specific issues with some older games. Thanks. ATI TRAY TOOLS is a great replacement for CCC, which can be problematic with these cards, vpu recover and other errors, which You will not get running ATT.

And yes use latest drivers even if its agp card, you still get bugfixes. This kind of re-assures me that I'm indeed having some sort of driver issue since this card is supposed to be vastly superior. It also doesn't run well with vert sync and tri-buffering.
